Terms & Conditions

NO PURCHASE NECESSARY.  NOMINEES MUST BE LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY AND WHO MEET THE ELIGIBILITY CRITERIA SET FORTH BELOW.  NOMINEES, FINALISTS AND/OR PREVIOUS BACK ON THE ROAD CONTEST NOMINEES, FINALISTS AND WINNERS ARE NOT ELIGIBLE TO PARTICIPATE. 


Please read below to learn how you can nominate yourself or another individual with a valid CDL Operator’s license to receive a year-long work agreement with Heartland Express and year-long truck usage courtesy of Arrow Truck Sales, Inc. (“Sponsor”).

1.  How to Submit a Nomination:

Individuals may be nominated for participation in the Contest online or via mail.  The Contest begins at 12:00:01 am Central Time (“CT”) on October 5, 2009 and ends at 11:59:59 pm CT on December 6, 2009 (the “Contest Period”).
Online: To nominate yourself or another individual (“Nominee”) for inclusion in the Contest, visit www.BackOnTheRoad2010.com (“Web Site”) during the Contest Period.  At the Web Site, those wishing to submit a nomination (“Nominators”) should click the “Submit Story” link, and they will then be asked to submit an essay (minimum 250 words required but not to exceed 750 words in English) on behalf of each Nominee they are nominating for inclusion in the Contest (as outlined in Section 3, below).  For a Nominator’s registration to be valid, he/she must provide all information requested in the online form at the Web Site as well as indicate his/her acceptance of these Terms & Conditions by clicking on the “I Accept” button on the registration page.  All online Nominators must have valid e-mail addresses.
Via Mail: To nominate yourself or another individual for inclusion in the Contest via mail, a Nominator must legibly print or type the following information on a single sheet of 8.5” by 11” paper:  The Nominator’s first and last name, full mailing address and phone number; and the Nominee's first and last name, full mailing address and phone number.  Mailing addresses that include P.O. Boxes will not be accepted.  On a separate sheet of 8.5” by 11” paper, the Nominator must legibly print or type an essay, minimum 250 words required but not to exceed 750 words in English, recommending the Nominee (as outlined in Section 3, below).  The Nominator must mail both sheets of paper together in a single envelope to:

Mailed Nominations must be received by December 14, 2009.  No photocopies or mechanically/electronically reproduced Nominations will be allowed or considered.  Sponsor shall not be responsible for Nominations or mail that is late, lost, misdirected, mutilated, incomplete, illegible, marked postage-due, or otherwise not timely delivered to Sponsor for any reason whatsoever.  Duplicate Nominations submitted by any Nominator online or via mail will void all Nominations submitted by the Nominator.  Upon receipt, Nominations shall become the sole property of Sponsor and will not be returned.  This Contest is void where prohibited by law.  By submitting a Nomination online or by mail, Nominators agree to the terms set forth in these Terms & Conditions.

2.  Eligibility Requirements:


To be considered in the Contest, each Nominee must be a legal resident of one of the 50 United States or the District of Columbia at least 26 years of age and have: a minimum of 10 years of licensed driving experience; 18 months of over-the-road driving experience, defined as driving in 3 or more states and staying out in the truck for 2-3 nights a week; a positive work history; a high school diploma; a valid CDL Operator’s license with HAZMAT; no criminal record; no DWI or OUI in the last 5 years; a satisfactory driver’s record, as defined by no reckless or careless driving in the last 5 years, no major accidents in the last 3 years, no more than 2 moving violations in the last 12 months, and no more than 1 serious violation in the last 5 years; and a favorable credit history.  The Nominee cannot have been off the road for more than 2 years and must pass a DOT physical and meet Heartland’s standards.  NOMINEES, FINALISTS AND/OR PREVIOUS BACK ON THE ROAD CONTEST WINNER(S) ARE NOT ELIGIBLE TO PARTICIPATE.  Each Nominee must also: agree to complete the application process (as outlined in section 3, below); be available for phone interviews in connection with the Contest; be available to travel to Kansas City, Missouri or another location as specified by Sponsor for one or more in-person and/or on-camera interviews in connection with the Contest; and be available for public relations efforts as directed by the Sponsor throughout the work agreement.  The following individuals are not eligible to participate in the Contest as either Nominees or Nominators: employees, contractors, directors and officers of Arrow Truck Sales, Inc. (the “Sponsor”), its parent, subsidiaries and affiliated companies, distributors, web design, advertising, fulfillment, legal, judging and contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, “Contest Parties”).


3.  How The Contest Works:


There are four stages of progression through the Contest.  The decisions of Sponsor’s Selection Committee are final and binding on all matters relating to this Contest and are not subject to any review or appeal.  


Stage One: A Nominator must write and submit an original essay (minimum 250 words required but not to exceed 750 words in English) describing the Nominee’s ability to triumph over his or her unfortunate circumstances beyond his or her control and demonstrating that he or she is deserving of this opportunity.  Contact information, including first and last name, full mailing address (no P.O. Boxes, please) and phone number for the Nominator and Nominee are also required for entry, as set forth above.  Entries that meet these requirements will be reviewed, and Sponsor will determine in its sole discretion which Nominees, will move forward to Stage Two of the Contest, based upon the judging criteria below.


Stage One Judging Criteria: Each Nominator essay will be judged on compliance with the requirements stated in these Terms & Conditions, completeness and originality of essay, and how deserving the Nominee is. 
The 20 highest scoring Nominees from Stage One (provided a sufficient number of qualified Nominations are received) will be notified by mail and will be asked to complete a detailed Contest application along with the Heartland Express work agreement application.  In connection with such applications, each such Nominee will be asked to provide information including but not limited to: all Nominee contact information; submission of a recent photo of the Nominee; signed consent forms authorizing checks of Nominee’s background, credit history, and driving record; as well as personal financial information, truck ownership and employment history, and any other information or documents requested by Sponsor.  In addition, each such Nominee will be required to confirm information/details supplied in the original Nominator’s essay (as described above), and to provide supplemental information to help judges understand why the Nominee is deserving of this opportunity and how it would affect his/her life. 

All of this information must be provided to Sponsor within the time set forth in the notification letter referenced above, or Nominee shall be disqualified.  Nominees who comply with these requirements will move forward to Stage Two of the Contest, based upon the judging criteria below.  In the event any of the top 20 highest scoring Nominees do not timely comply with these requirements, Sponsor will notify the next highest scoring Nominee, and will repeat this process until 20 Nominees have been verified (provided a sufficient number of qualified nominations are received).


Stage Two: The 20 highest scoring Nominees from Stage One (provided a sufficient number of qualified Nominees remain) who comply with all of the above requirements will be asked to participate in phone interviews regarding their experiences and stories.  Nominees should convey that they are reliable, articulate, personable, and enthusiastic.  Such Nominees will be judged by Sponsor, and Sponsor will determine which Nominees will move forward to Stage Three of the Contest, based on the judging criteria below.


Stage Two Judging Criteria: In his/her phone interview, each Nominee will be judged upon his/her articulation, personality, enthusiasm, pleasantness, and reliability, as well as upon the degree to which his/her story is compelling.


Stage Three: 10 Nominees from Stage Two will be selected to move forward to Stage Three (provided a sufficient number of qualified Nominees remain).  During Stage Three of the Contest, a background check and credit check will be run on each remaining Nominee.  Sponsor reserves the right to require a confidential background check to help ensure that the selection of any particular Nominee would not bring Sponsor or Contest Parties into public disrepute, contempt, scandal or ridicule or reflect unfavorably upon the Contest, Sponsor, or Contest Parties, as determined by Sponsor in its sole discretion, and that the awarding of the Contest prize to such Nominee would not violate applicable State or Federal laws or regulations.  If any Nominee has been convicted of a felony or a misdemeanor of moral turpitude or has filed a petition in bankruptcy within the previous seven (7) years, or if Sponsor determines in its sole discretion that the selection or use of the Nominee in advertising might reflect unfavorably on the Sponsor or that the awarding of the prize may violate applicable State or Federal laws or regulations, the Sponsor may disqualify the Nominee.

 
Stage Four: Nominees who are not disqualified in Stage Three shall be selected to move forward to Stage Four of the Contest, during which Sponsor will conduct personal interviews of each remaining Nominee in Kansas City, Missouri or in another location specified by Sponsor.  As necessary for Nominees to participate in such interviews, Sponsor will pay for the airfare, ground transportation, lodging and meals for each Nominee and one (1) eligible guest of each Nominee.  One (1) Nominee will be selected to receive the Contest prize of a year-long work agreement with Heartland Express and year-long truck usage courtesy of Arrow Truck Sales.


Stage Four Judging Criteria: In the personal interviews, each Nominee will be judged upon his/her appearance, enthusiasm, presentation skills, articulation and reliability. 


4.  Notification of Winner:


Certain Nominees, including the Contest Winner, may be offered the opportunity to attend the Mid-America Trucking Show at the Kentucky Exposition Center to be held in Louisville, KY from March 25, 2010 through March 27, 2010.  The Sponsor will pay for airfare, ground transportation, lodging and meals in connection with the Mid-America Trucking Show at the Kentucky Exposition Center for invited Nominee’s and for one (1) eligible guest to travel with the qualifying Nominee. The Contest Winner must be present at the Show in order to be declared the winner.

5.  Prize Details:


The winning Nominee ("Winner") will receive the use of a 2007 Volvo VNL 670 tractor or Volvo equivalent (the “Tractor") for one year, and will receive a one-year employment agreement with Heartland Express.  In addition, the Winner will receive all required insurance, maintenance, bookkeeping services, parts and supplies for the Tractor for the duration of the employment agreement.  The person who nominated the winning Nominee will not receive any prize.  If Winner remains employed with Heartland Express for the one-year duration of the employment agreement, Winner will be given full ownership of the Tractor.  Otherwise, Winner must return the Tractor to Sponsor immediately at the end of the year or the termination of Winner’s employment with Heartland Express.  If Sponsor determines, in its sole discretion, that Winner has violated any of these terms (including but not limited to the selection of any particular Nominee bringing the Sponsor or Contest Parties into public disrepute, contempt, scandal or ridicule or reflect unfavorably upon the Contest, Sponsor, or Contest Parties) during the one-year employment/usage period, the entire prize will be forfeited, employment may be terminated, and the Tractor must be immediately returned to Sponsor.


6.  General Rules:


No transfer of prize by Winner is permitted.  No cash equivalent or substitution of prize is offered.  All federal, state and local taxes related to the prize are the sole responsibility of Winner.  Taxes related to employment will be handled as with any other employee of Sponsor.  All federal, state and local laws apply.  Potential Winner must sign and return required documents, certifying that Winner consents to use and publication of entry.  All Nominators and Nominees who participate agree to Sponsor’s publicizing nominations in chat rooms, blogs and via fliers that will be distributed at major truck stops nationwide.  Nominees must also consent to participate in the personal interviews to be held in Kansas City, Missouri, and agree to participate in the Mid-America Trucking Show at the Kentucky Exposition Center and any additional public appearances in connection with the Contest, as requested by Sponsor throughout the work agreement and truck usage term.  Non-compliance within required time periods may result in disqualification and an alternate Winner may be selected.  Return of any prize/prize notification(s) as undeliverable will result in disqualification and an alternate Winner may be selected.  Sponsor reserves the right to: (a) use Nominator’s and winning Nominee’s names, voice, photos and likenesses and publish all entries submitted; (b) alter, amend, edit or change entries prior to publication; and (c) use, publish, reproduce, alter, amend and copyright all entries for purposes of advertising, marketing, and trade without further compensation, unless prohibited by law.
By accepting prize, winner agrees to hold Sponsor, ITS Contest PRIzE participants, and the contest parties, as well as their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of or relating in any manner to the use of tractor, or other components of the prize.   by accepting the prize, winner acknowledges that the one-year employment agreement is with heartLand express and not with sponsor, and winner hereby agrees to fully release and discharge sponsor and its employees; officers; directors; attorneys; parent, subsidiary and affiliated companies; successors and assigns from any liability or damages ARISING out of or relating in any manner to winner’s employment agreement or employment with heartland express.  Entrants agree to release, discharge and hold harmless Sponsor, its Contest prize participants, contest parties, parent company, and their respective subsidiaries, affiliates, officers, directors, shareholders, employees, agents, attorneys, other representatives, advertising, Contest and fulfillment agencies, harmless from and against any and all liability and damages ARISING OUT OF Or RELATED To THE cONTEST, THE SELECTION PROCESS OR THE DECISIONS OF THE SPONSOR.  By participating in this Contest, entrants agree to be bound by these Terms & Conditions and the decisions of the CONTEST judges.

Sponsor shall not be responsible for misdirected or undeliverable e-mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  If, in the Sponsor’s sole opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, Sponsor reserves the right to terminate the Contest and judge only those entries received as of the date of termination.  Sponsor is not responsible for any typographical or other error in presentation/administration of Contest, prize announcements, or these Terms & Conditions, or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest.
